Submission to the Senate Inquiry into the Fair Work Legislation Amendment (Closing Loopholes) Bill 2023

Summary of recommendations

We endorse the recommendations of the Australian Council of Trade Unions and recommend that they be implemented in full. We also emphasise the need for ongoing consultation and periodic review of the new provisions.

Recommendation 1: That the Australian Government incorporate review provisions into the Fair Work Act 2009 (Cth) which provides that the new provisions in Part 16 of Schedule 1 should be reviewed three years after the date it begins to operate.

Recommendation 2: That the Australian Government is a matter of priority consult with workers who come within the legal remit of 'employee-like workers' and their representatives when reviewing the provisions of the Fair Work Act 2009 (Cth).
